Terms of Service
Last updated: November 2, 2026
1. Agreement to these terms
These Terms and Conditions ("Terms") are a legal agreement between you and ServCue ("we," "us," or "our"). They govern your use of servcue.com (the "Website") and ServCue for Managers and our related apps and software (together, the "Services").
By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
If you accept these Terms on behalf of a restaurant or other business ("Customer"), you confirm that you have authority to bind that business. "You" then refers to both you and the Customer.
Eligibility. You must be at least 18 years old to purchase a plan or administer an account. Staff users must meet the minimum working age where they are employed.
2. Accounts
- Account setup. After purchase, we email login credentials so you can download and access the Services. Customers may add managers and staff as users.
- Account administrators. The Customer's owner or designated administrator controls who has access, what each user can see, and when accounts are added or removed.
- Your responsibilities. Keep your login credentials confidential, change any temporary password after first login, and do not share accounts. You are responsible for all activity under your account.
- Accurate information. You agree to provide accurate information and keep it up to date.
- Security issues. Tell us right away at hello@servcue.com if you suspect unauthorized access to your account.
3. Plans, payment and cancellation
- Plans. We offer paid Essential and Team plans. Features, limits and prices are listed on the Website at the time of purchase.
- Payment. Payments are processed by Stripe. By purchasing, you also agree to Stripe's terms. We do not store your full card details.
- Subscriptions and renewal. Plans are billed in advance on a [monthly / annual] basis and renew automatically until cancelled. You authorize us to charge your payment method at each renewal.
- Price changes. We will give you at least 30 days' notice of any price change. It takes effect at your next renewal.
- Cancellation. You can cancel anytime by contacting us at hello@servcue.com [or through your account settings]. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Refunds. Except where required by law, fees already paid are non-refundable, including for partial billing periods.
- Taxes. Prices do not include taxes. You are responsible for any applicable sales or similar taxes.
- Late payment. If a payment fails, we may suspend access until it is resolved.
4. Your data and AI features
You own your data. Information you or your users enter into the Services, including staff names, schedules and training records ("Customer Data"), belongs to the Customer. You give us permission to use Customer Data only to provide, secure and improve the Services, as described in our Privacy Policy.
Your responsibilities for staff data. You are responsible for having the right to enter your staff's information into the Services, for telling staff that you use ServCue, and for following employment and privacy laws that apply to you.
AI features. The Services use artificial intelligence to automate tasks and generate content and insights. AI output can be incomplete or wrong. You are responsible for reviewing it before relying on it. ServCue is a tool to support managers, not a substitute for their judgment, and you remain responsible for all scheduling, hiring, discipline, pay and other employment decisions.
Aggregated data. We may create anonymized, aggregated data that does not identify you, your staff or your restaurant, and use it to improve and report on the Services.
5. Acceptable use and third-party tools
You agree not to:
- Use the Services for anything unlawful, harmful, harassing or discriminatory
- Enter information you do not have the right to share
- Access or try to access accounts or data that are not yours
- Copy, resell, reverse engineer or build a competing product from the Services
- Interfere with, overload or test the security of the Services without our written permission
- Upload malware or use bots or scrapers on the Services
Third-party tools. If you connect scheduling, point-of-sale or other third-party tools, your use of those tools is governed by their own terms. We are not responsible for third-party tools, their availability, or changes that affect our integrations.
6. Intellectual property and feedback
ServCue and its licensors own the Services, including the software, design, automations, logos and the ServCue name. We grant you a limited, non-exclusive, non-transferable license to use the Services for your restaurant's internal business purposes while your plan is active. No other rights are granted.
If you send us ideas, suggestions or feedback, we may use them freely without any obligation to you.
7. Disclaimers, liability and indemnification
Disclaimer. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR PRODUCE ANY PARTICULAR BUSINESS RESULT.
Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, SERVCUE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
Indemnification. You agree to defend and indemnify ServCue against claims arising from your misuse of the Services, your violation of these Terms, or Customer Data you entered without the right to do so.
8. Termination, governing law and changes
Termination. You may stop using the Services and cancel your plan at any time. We may suspend or end your access if you violate these Terms, fail to pay, or use the Services in a way that could harm others. After termination, you can request an export of your Customer Data within 30 days, after which we may delete it.
Governing law. These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Knox County, Tennessee, and both parties consent to those courts' jurisdiction. Before filing a claim, each party agrees to try to resolve the dispute informally for at least 30 days.
Changes to these Terms. We may update these Terms from time to time. We will change the "Last updated" date and, for significant changes, notify you by email or through the Services. Continuing to use the Services after changes take effect means you accept them.
General. If any part of these Terms is found unenforceable, the rest stays in effect. These Terms and our Privacy Policy are the entire agreement between you and ServCue about the Services.
